Conduct: James Junior Forna (“Mr Forna”) caused JF Electrical/Mechanical Ltd (“JFEM”) to apply for a Bounce Back Loan (“BBL”) of £50,000, received by the company on 05 June 2020, when he knew or ought to have known that the company turnover he included in the BBL application was overstated. As a result, JFEM received more than it was entitled to from the BBL scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started; • JFEM was incorporated on 29 December 2010 and started to trade in 2012. JFEM’s accounts for the year ended 31 December 2019 disclose a turnover of £82,365; • Mr Forna applied for a BBL of £50,000 on behalf of JFEM declaring that its annual turnover was £200,000. JFEM received the BBL funds of £50,000 on 05 June 2020; • Based on JFEM’s turnover of £82,365 from the accounts for the year ended 31 December 2019, the company was entitled to a BBL of no more than £20,592, and JFEM received £29,408 more than it was entitled to from the BBL scheme; • Total liabilities at liquidation were £149,070, including £43,784 owed to the bank in respect of the BBL obtained.
