Conduct: On 02 February 2021, Stephen Curl (“Mr Curl”) breached the terms of the government backed Bounce Back Loan (“BBL”) scheme by overstating the turnover of Stamford Engineering Limited (“SEL”) in its application for a BBL, causing SEL to receive a BBL of £40,000 to which it was not entitled, in that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it was their estimated annual turnover from the date the business started. • SEL was incorporated on 8 December 2010 and commenced trade in such year. • SEL’s annual accounts for the financial year ending 31 December 2019 show turnover of £118,179. • On 02 February 2021, Mr Curl applied for a BBL of £40,000 on behalf of SEL, stating the company turnover as £170,000. • Consequently, the company received a £40,000 BBL that was deposited into the company account on 04 February 2021. • As a result of the application, Mr Curl caused SEL to receive more BBL funds than entitled to. • At liquidation, the company has liabilities totalling £67,547.62, of which at least £40,000 was owed in respect of the BBL.
