Conduct: Mrs Beverly Mary Hydes (Mrs Hydes”) failed to ensure A. Hydes Ltd (“AHL”) complied with health and safety legislation in that an employee suffered an accident at work. On 17 September 2015, AHL pleaded guilty to a breach of Health & Safety at Work etc Act 1974 S2(1). As a result, on 12 November 2015, and seven days after entering liquidation, AHL was fined and ordered to pay costs and Mandatory Victim Surcharge.

  • On 19 June 2014 an employee was injured at work and was hospitalised for 10 days.
  • On 12 October 2014 the Health and Safety Executive (“HSE”) advised AHL of breaches to Health & Safety legislation.
  • After further correspondence with AHL the HSE decided to prosecute AHL for a single breach of the Health and Safety at Work etc. Act 1974 Section 2(1).
  • AHL pleaded guilty at the first hearing on 17 September 2015 at Derby Magistrates Court.
  • On 02 October 2015, her co-director met with an Insolvency Practitioner and on 05 November AHL entered Creditors’ Voluntary Liquidation.
  • On 12 November 2015 AHL was found guilty and a fine of £12,000 was imposed. The court ordered a further £5,739 be paid in costs and £120 Mandatory Victim Surcharge.
