Conduct: Mr Michael Bowyer (Mr Bowyer) caused Lord Elgin Limited (the company) to obtain a Bounce Back Loan in the sum of £50,000 when he knew, or ought to have known, that the company was not entitled to that amount under the terms of the BBL Scheme. As a result, the company obtained funds in excess of its legitimate entitlement, in that: • Under the BBL Scheme, a business could apply for a loan between £2,000 and £50,000, capped at 25% of its annual turnover for the calendar year 2019. Where a business was established after 1 January 2019, applicants were instructed to apply the 25% limit to their estimated annual turnover from the date the business commenced trading. • Lord Elgin Limited was incorporated on 11 December 2010. Accordingly, the company was required to use its actual turnover for the 2019 calendar year. • The company’s financial year runs from 30 November 2018 to 30 November 2019. The Company Accounts (P&L Accounts) from that period show turnover figure of £10,855 • Analysis of the Company’s bank statements shows that the actual turnover for 2019 was £2,220. • On 19 May 2020, Mr Bowyer signed a Bounce Bank loan agreement on behalf of Lord Elgin Limited, declaring the turnover of £200,000. The company subsequently received £50,000 in BBL funds on 22 May 2020 despite only being entitled to a maximum loan of only £2,714. • Repayments totalling £7,923 have been made towards the BBL. • On 06 March 2025, Lord Elgin Limited entered Creditor Voluntary liquidation with total liabilities of £43,184 of which £42,077 related to the outstanding BBL.
