Conduct: Joanne Rowan (“Ms Rowan”) caused The Rowan Pub Company Limited (“Rowan”) to make a false application for a Bounce Bank Loan (“BBL”) when it was not entitled to funds from the BBL scheme in that: • The BBL criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover. The funds could only be used to provide economic benefit to the company and not for personal purposes. • Ms Rowan signed the application for the BBL on 11 February 2021 and the company received £50,000 on 12 February 2021. • The BBL application form states: o With the submission of this loan application, you, the Borrower, declare the following: o 1. I/We confirm that my/our business was carrying on its business on 1 March 2020, that I was/we were engaged in trading or commercial activity in the United Kingdom as at the date of this application 3, and the business has been adversely impacted by COVID-19 • The company accountants have provided a report which confirms the transfer of Rowan’s business to a connected company on 31 July 2020. • Ms Rowan has stated that the company was effectively dormant after the transfer of the business and its assets on 31 July 2020. • Due to the sale of Rowan’s business to a connected company it had not been trading from 1 August 2020 and was not trading on 11 February 2021 and was therefore not entitled to the BBL.
