Conduct: Mrs Kerry Jane Heslop (“Mrs Heslop”) breached the terms of the Bounce Back Loan Scheme by failing to ensure that BBL funds were used for the economic benefit of Foremost Barclay Limited, in that: • The BBL scheme rules allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which those businesses would self-certify when completing the BBL application • The BBL scheme required the funds to only be used to provide economic benefit to the business. • Foremost Barclay was incorporated on 02 August 2010. • On 18 June 2020, Foremost Barclay applied for a BBL of £50,000. • On 22 June 2020, the £50,000 BBL funds were paid into Foremost Barclay’s bank account. • The balance of the bank account prior to receipt of the BBL funds was £12,109. On receipt of the BBL, the bank account balance was £62,109. • The only income paid into Foremost’s bank account between receiving the BBL funds on 22 June 2020 and 05 November 2020 was transactions totalling £7,470 from HMRC’s covid job retention scheme. • Between 22 June 2020 and 05 November 2020 the BBL funds were withdrawn from Foremost’s account via transactions to Mrs Heslop totalling £65,125 and to a family member £2,172 and 3rd parties £1,839. • Therefore, these transactions included at least £49,557 of the funds received by Foremost in respect of the BBL. • Mrs Heslop has failed to provide any evidence that the payments made to her from the BBL monies were for the economic benefit of Foremost Barclay. • At liquidation, Foremost Barclay owed £50,248 to the Bank in respect of the BBL.
