Conduct: Simon Grant Gorgin (“Mr Gorgin”) caused P3 Estates Limited (“P3 Estates”) to apply for a Bounce Back Loan (“BBL”) of £45,000, when he knew or ought to have known that P3 Estates was not eligible under the scheme as P3 Estates was not trading at 01 March 2020 or at the time Mr Gorgin made the BBL application, contrary to the BBL scheme terms and conditions. The BBL funds were paid to Mr Gorgin personally and were not used for the economic benefit of the company. Mr Gorgin failed to give notice to the bank of the dissolution of P3 Estates as required by Section 1006 of The Companies Act 2006. Under the BBL scheme the applicant must be carrying on business on 01 March 2020 and at the time of the BBL application and had to self-certify that they will use the loan only to provide economic benefit to the business and not for personal use. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover and confirm they have understood the costs associated with repayment of the loan and that they are able and intend to complete timely repayments in future P3 Estates filed dormant accounts for the years ending 30 April 2019 and 30 April 2020 and therefore was not trading as at 01 March 2020. Bank account statements shows that P3 Estates was not trading at the time of the BBL application. On 08 May 2020, P3 Estates applied to its bank for a BBL for £45,000 stating its turnover to be £180,000. On 09 May 2020, P3 Estates received £45,000 in respect of the BBL, increasing the available bank balance to £45, 025 On 12 May 2020, £45,000 was transferred to Mr Gorgin’s personal bank account. On 14 April 2021 Mr Gorgin signed notice DS01 Striking off Application by a company, which was received at Companies House on the same date. Mr Gorgin failed to comply with section 1006 of the Companies Act 2006 as he failed to notify the bank of his intention to dissolve P3 Estates. The company was dissolved on 02 December 2021, as at which time the full amount of £45,000 of the BBL remained outstanding.
