In that: • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it commenced trading if it had been established after 01 January 2019), to a maximum of £50,000; • H2T was incorporated in February 2010 and commenced trading at that time; • As H2T was trading throughout 2019 it was not entitled to estimate its turnover on the application form; • H2T’s bank statements record income of £17,823 in 2019, which would have entitled it to a BBL of no more than £4,456; • H2T’s accounts for year ending 31 March 2020 state turnover of £49,391 which would have entitled it to a BBL of no more than £12,347. • On 11 May 2020 Mrs Perks’ co-director completed an application form for a BBL from H2T’s bank, self-certifying that its turnover in 2019 was £208,000 and requesting a loan of £50,000; • The BBL was received on 12 May 2020; • Therefore H2T obtained at least £37,653 in BBL funding to which it was not entitled; • At the liquidation date £49,959 remained outstanding in respect of the BBL and the bank was the majority creditor.
