Conduct: Marie Townsend (“Mrs Townsend”) caused DML Digital Ltd (“DML”) to breach the conditions of the BBL scheme by obtaining a 2nd BBL on 07 September 2020, despite a limited company only being allowed one BBL. Mrs Townsend knew or ought to have known that DML was not entitled to a 2nd loan since it was stipulated in both the BBL application she signed on 12 May 2020, and the 2nd application. Further, Mrs Townsend provided financial information she knew or ought to have known was incorrect in order to obtain the 2nd loan. In that: Mrs Townsend was appointed as the sole director of DML on 19 November 2009. A condition (“The Condition”) of the BBL scheme was businesses affected by COVID-19 were able to apply for a single loan of up to 25% of their turnover up to a maximum loan of £50,000. DML’s SAGE data suggests that it had a turnover of £126,288 for the 2019 calendar year. Under The Condition, DML’s turnover allowed a maximum BBL of £31,572. Mrs Townsend made an application for a £35,000 BBL, dated 12 May 2020, which included confirmation that the information provided in it was complete and accurate. The application form included The Condition and stated that DML’s annual turnover for 2019 was £142,400. On 13 May 2020, DML received £35,000. On or around 02 September 2020, Mrs Townsend made an application to a second lender for a £50,000 BBL. The application stated that DML’s annual turnover for 2019 was £200,000. As part of the application, Mrs Townsend confirmed a statement that the Company had not previously received a BBL and that the information provided was complete and accurate. On 07 September 2020, DML received £50,000 from the second lender. Total liabilities at liquidation amount to £203,658 which includes debts of £88,391 in respect of the two BBLs.
