Conduct: On 08 July 2020, Mr Timothy Stewart Mayatt (“Mr Mayatt”) caused Farningham Butchers Limited (“Farningham”) to apply for a Bounce Back Loan (“BBL”) of £50,000 when he knew or ought to have known that Farningham was not entitled to a loan of that amount. Mr Mayatt made an inaccurate declaration on the BBL application using an overstated turnover figure of £300,000. As a result, Farningham received more BBL funds than it was entitled to, in that: • The terms of the Bounce Back Loan Scheme stated that a business could apply for a loan of up to 25% of the Company’s turnover, from a minimum of £2,000, up to a maximum of £50,000. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated turnover.   • Farningham was incorporated on 07 August 2009, commencing trading around August 2009 and therefore required to provide turnover for the calendar year 2019. • On 08 July 2020, Mr Mayatt applied for a BBL on behalf of Farningham. He stated on the application form that Farningham had a turnover of £300,000. • On 08 July 2020, Farningham received a BBL of £50,000. • Analysis of the Company’s bank statements show credits totalling £81,768 in the calendar year of 2019. • On 29 September 2020, Mr Mayatt approved Farningham’s financial statements for the year ended 31 December 2019 which showed Farningham’s turnover of £101,010. • Based on the turnover of £101,010, Farningham was eligible to apply for a BBL of £25,252.50. By overstating the turnover, Mr Mayatt caused Farningham to receive £24,747.50 more than it was entitled to. • Total liabilities at Liquidation amount to £66,524 of which at least £38,786 relates to the amount owed in respect of the BBL.
