Conduct: Idris Mohammed (hereinafter referred to as Mr Mohammed) failed to ensure that I.B.T. UK Ltd (“IBT”) declared its true Value Added Tax (“VAT”) liabilities on returns and refund claims submitted to HMRC from 01 April 2011 to 08 June 2017 (when the quarter ended 05/17 fell overdue), which resulted in additional VAT and Corporation tax liabilities and penalties that remained unpaid at the date of Liquidation.

  • IBT was registered for VAT purposes with effect from 10 September 2009;
  • IBT submitted inaccurate VAT returns / VAT refund claims to HMRC for the period from 01/04/11 to 30/11/13, and for the subsequent fourteen VAT quarters ending: 02/14, 05/14, 08/14, 11/14, 02/15, 05/15, 08/15, 11/15, 02/16, 05/16, 08/16, 11/16, 02/17 and 05/17;
  • On 22 June 2016 and 29 March 2017, HMRC made unannounced visits to IBT, during which HMRC assessed IBT’s procedures for recording cash sales and non-cash sales. The result of which HMRC concluded that IBT under-declared its sales and therefore under-declared its associated VAT liabilities;
  • On 12 February 2018, HMRC raised an Officer’s Assessment to IBT for additional VAT liabilities totalling £238,483 for the period from 01/04/2011 to 30/11/2013 and for the subsequent fourteen VAT quarters ending: 02/14, 05/14, 08/14, 11/14, 02/15, 05/15, 08/15, 11/15, 02/16, 05/16, 08/16, 11/16, 02/17 and 05/17. In addition, HMRC raised interest charges of £11,216 against the outstanding VAT liabilities. These amounts remained outstanding at the date of liquidation;
  • Subsequently and as a result of the under declared sales, HMRC raised additional Corporation Tax liabilities of £535,988 for six tax years ended 31st March 2012 to 31 March 2017. These amounts remain unpaid at the date of liquidation;
  • The amount due to IBT’s creditors in the liquidation totalled £875,363. Of this amount, at least £831,712 is owed to HMRC, which includes £263,644 of outstanding VAT liabilities (£4,807 due post liquidation), £535,988 of outstanding Corporation Tax liabilities, and interest charges of £31,186.
