Conduct: Fayyaz Bashir Jamal (“Mr Jamal”) failed to ensure that L F F Limited (“LFF”) complied with its obligations as an employer under the Immigration, Asylum and Nationality Act 2006 (“the IAN Act”), in that LFF employed twelve illegal workers and following six visits to LFF’s various trading premises by Home Office Immigration Enforcement (“HOIE”) (formerly the UK Border Agency), between 01 May 2013 and 22 December 2014, received fines totalling £205,000. LFF failed to pay the penalties in full and the sum of £181,013 remained outstanding at the date of Liquidation.

  • He was the sole appointed director of LFF from 09 February 2009 (the date of incorporation) to 13 February 2015 (when Mr Mobeen Ahmed was appointed as joint director).
  • On 01 May 2013, HOIE officers visited on of LFF’s trading premises and discovered an illegal worker. On 09 October 2013, HOIE issued a Civil Penalty Notice totalling £5,000 of which £2,879 was paid leaving £2,121 outstanding at the date of liquidation.
  • On 21 August 2014, HOIE officers visited one of LFF’s trading premises and discovered two illegal workers. On 03 October 2014, HOIE issued a Civil Penalty Notice totalling £20,000 of which £4,993 was paid leaving £15,007 outstanding at the date of liquidation.
  • On 26 November 2014, HOIE officers visited three of LFF’s trading premises and discovered seven illegal workers, one of which they had already discovered during the raid on 21 August 2014. On 29 January 2015 and 03 February 2015, HOIE issued three Civil Penalty Notices totalling £140,000 (£40,000, £40,000 and £60,000). LFF made payments totalling £11,671 against these penalties, leaving £128,329 outstanding at liquidation.
  • On 22 December 2014, HOIE officers visited LFF’s trading premises and discovered two illegal workers. On 12 February 2015, issued a Civil Penalty Notice totalling £40,000 of which £4,444 was paid leaving £35,556 outstanding at liquidation.
  • As the sole registered director of LFF on the date of the HOIE visits, he was responsible for ensuring that LFF complied with all relevant legislation, including legislation relating to the employment of persons eligible to work.
