Conduct: On 07 May 2020, having previously applied for a Bounce Back Loan (“BBL”) of £50,000 in IMA from another lender, Mr Zulfiqar caused IMA to wrongfully apply for a second BBL of £50,000. Further, on 18 May 2020 Mr Zulfiqar caused IMA to wrongfully apply for a third BBL of £50,000. Both BBLs were obtained contrary to the terms and conditions of the BBL scheme and Mr Zulfiqar knew or ought to have known that was the case. In that: - • The BBL scheme allowed businesses affected by the Coronavirus pandemic to apply for a government backed loan of 25% of turnover in the calendar year 2019, from a minimum of £2,000 up to a maximum of £50,000. • On 06 May 2020 Mr Zulfiqar submitted an application form to NatWest in which IMA sought a BBL of £50,000 and which contained a declaration which confirmed that this was the only application for a BBL that had been made on behalf of IMA. • On 11 May 2020 IMA received a BBL of £50,000 from NatWest. • Guidance available on the British Business Bank website, as at 06 May 2020, confirmed that, in order to be eligible to apply for a BBL, borrowers were required to be able to declare that “The business (and any wider group of which it is part) is not in the process of applying for or has not already received a Bounce Back Loan Scheme facility”. • On 07 May 2020, Mr Zulfiqar submitted an application form to Santander in which IMA sought a BBL of £50,000 and which contained a declaration which confirmed that this was the only application for a BBL that had been made on behalf of IMA. • On 08 May 2020 IMA received a BBL of £50,000 from Santander. • On 18 May 2020, Mr Zulfiqar submitted an application form to Lloyds, in which IMA sought a BBL of £50,000 and which contained a declaration which confirmed that this was the only application for a BBL that had been made on behalf of IMA. • On 20 May 2020 IMA received a BBL of £50,000 from Lloyds. • IMA was wound up by the high court on 04 October 2023. NatWest submitted a claim in the liquidation of £24,442 in relation to the outstanding BBL. The loan IMA received from Santander was repaid in full on 08 March 2021. The outstanding balance on the BBL received from Lloyds is £48,345.
