Conduct: Ishwerlal Barber failed to ensure that Shiv Motors Limited (“Shiv”) complied with its obligations to Her Majesty’s Revenue and Customs (“HMRC”), to submit accurate Corporation Tax Returns together with payment in respect of the financial years ended 30 June 2009, 30 June 2010, 30 June 2011, 30 June 2012 and 30 June 2013. As a result, Shiv’s liabilities to HMRC in respect of Corporation Tax were at least £81,189.54 (excluding interest). In that:

  • Shiv submitted Corporation Tax Returns in respect of the periods ended 30 June 2009, 30 June 2010, and 30 June 2011. These disclosed liabilities in respect of Corporation Tax of £2,256.45, all of which related to the period ended 30 June 2009. The returns in respect of the periods ended 30 June 2010 and 30 June 2011 stated there were no liabilities. HMRC opened a compliance investigation into Shiv’s tax affairs on 8 October 2010.
  • As a consequence of this investigation, HMRC established that Shiv had under declared its sales, and that questionable payments had been made by Shiv. As a result, HMRC and Shiv’s agent agreed Corporation Tax Liabilities of £55,335.05 (including interest of £22,641.11), and liabilities in respect of section 419 of the Income and Corporation Taxes Act 1998, and section 455 of The Corporation Tax Act 2010 in the sum of £33,374.00.
  • Shiv made payments of only £2,256.45 in relation to Corporation Tax.
  • HMRC was the only creditor to lodge a claim in Shiv’s liquidation
