Conduct: Burr Commercial Ltd On 15 September 2020 Mr Carl Sandiford Burrows (Mr Burrows) caused Burr Commercial Ltd (Commercial) to breach the conditions of the Bounce Back Loan (BBL) facility by applying for a second BBL of £50,000 when he knew or ought to have known that Commercial was not entitled to this. In that: • Under the BBL scheme businesses were able to apply for up to 25% of their turnover to a maximum of £50,000. Businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan, however the total loan amount was not to exceed 25% of the business’s turnover. Only one loan was available to businesses.   • On 10 June 2020 Mr Burrows made an application with Bank A for a BBL of £50,000 on behalf of Commercial. The BBL funds were paid into Commercial’s bank account held with Bank A on 17 June 2020. Commercial met the eligibility criteria for a £50,000 BBL. • On 15 September 2020 Mr Burrows made a further application with Bank B for a BBL of £50,000 on behalf of Commercial. The BBL funds were paid into Commercial’s bank account held with Bank B the same day. • The BBL application form for Bank B included a self declaration by Mr Burrows that “this is my/our only application for a Bounce Back Loan for this business”. • Mr Burrows knew or ought to have known that Commercial was not entitled to the second BBL when the second application for the BBL was made and the funds were received. • Commercial entered Creditors Voluntary Liquidation on 28 March 2022. • The Statement of Affairs for Commercial, as at 23 March 2020, showed liabilities of £83,499, of which £50,000 related to Bank A. However this did not include the £50,000 BBL in respect of the further BBL relating to Bank B, as Mr Burrows failed to disclose this to the liquidator of Commercial. Burr Living Ltd On 23 October 2020 Mr Carl Sandiford Burrows (Mr Burrows) caused Burr Living Ltd (Living ) to breach the conditions of the Bounce Back Loan (BBL) facility by applying for a second BBL of £50,000 when he knew or ought to have known that Living was not entitled to this. In that: • Under the BBL scheme businesses were able to apply for up to 25% of their turnover to a maximum of £50,000. Only one loan was available to businesses.   • On 02 June 2020 Mr Burrows made an application with Bank A for a BBL of £50,000 on behalf of Living. The BBL funds were paid into Living’s bank account held with Bank A on 08 June 2020. Living met the eligibility criteria for a £50,000 BBL. • On 23 October 2020 Mr Burrows made a further application with Bank C for a BBL of £50,000 on behalf of Living. The BBL funds were paid into Living’s bank account held with Bank C on the 26 October 2020. • Mr Burrows knew or ought to have known that Living was not entitled to the second BBL when the second application for the BBL was made and the funds were received. • Living entered Creditors Voluntary Liquidation on 28 March 2022. • The Statement of Affairs for Living, as at 23 March 2020, showed liabilities of £107,905, of which £50,000 related to Bank A. However this did not include the £50,000 BBL in respect of the further BBL relating to Bank C, as Mr Burrows failed to disclose this to the Liquidator of Living.
