Conduct: •Between 27 April 2023 and 30 May 2023, Mr Churchward caused BCQ Group Ltd to misuse its Invoice Finance Facility (“I.F.F”) by submitting notifications for non-existent debts, resulting in a loss to the lender of £383,780, in that: o BCQ traded as a printing business with mainly corporate customers and operated an I.F.F with its lender. o From 01 January 2019 until his suspension on 20 July 2023, Mr Churchward was a director of BCQ with responsibility for financial matters, including debtor reporting and the operation of the I.F.F. o An audit conducted by the lender from 17 to 19 July 2023 established that between 27 April 2023 and 30 May 2023, notifications totalling £843,303 were submitted to the lender using Mr Churchward’s unique login credentials, for which no genuine invoices had been issued by BCQ. o The lender has confirmed that after applying recoveries of genuine debts, its financial loss arising from these false notifications was £383,780. o At administration, BCQ owed creditors £8,046,286, with a deficiency of £3,951,660, and the misuse of the I.F.F artificially supported BCQ’s trading position to the detriment of creditors, particularly the lender.
