Following liquidation HMRC claimed a total of £4,756,231 of which £2,413,398 was in respect of VAT and £2,342,833 was in respect of CT

Conduct: Between 8 August 2015 and Liquidation on 9 September 2019 I failed to ensure ALP Scaffolding Services Limited (“ALP”) complied with its statutory obligations to HM Revenue & Customs (“HMRC”) to submit accurate returns and pay the correct amounts due in respect of VAT from 8 August 2015. I caused or allowed ALP to declare incorrect amounts of VAT due and ALP to fail to comply with statutory obligations to file returns and pay VAT as it fell due. In respect of Corporation Tax from 2 January 2016 I caused or allowed ALP to file incorrect returns that under declared profits or failed to file returns. Following liquidation HMRC had claims totalling £2,692,007 of which £1,727,876 was outstanding in respect of VAT and £964,131 was outstanding in respect of Corporation Tax: VAT HMRC have stated that during their checks into the company’s tax affairs, HMRC found that the company had not declared the right amount of VAT. HMRC have stated that this was because I as a shadow officer of the company deliberately failed to file VAT returns in order to evade the amounts due to HMRC. I caused or allowed those VAT returns to be submitted Following Liquidation HMRC had a claim in respect of VAT of £1,727,876 in respect of the quarters 06/15 to 09/19 when the company entered Liquidation. Corporation Tax HMRC found returns submitted for years ended 31 March 2015 and 31 March 2016 to be incorrect in that they under declared profits. I caused or allowed those returns to be submitted. No returns were submitted for the years ended 31 March 2017 and 31 March 2018. HMRC determined that the following amounts had been under declared and had a claim of £964,131 at Liquidation in respect of Corporation Tax, this claim included: For 2014/15 HMRC determined a main discovery assessment of £72,282 was under declared. For 2015/16 HMRC determined an amended self-assessment £250,823 was under declared. For 2016/17 HMRC determined a main discovery assessment £453,416 was under declared For 2017/18 HMRC determined a main revenue determination £181,909.80 was under declared. Penalties of £5,700.
