Conduct: In May 2020, Mr Jonathan Philip Cooke caused Stockford Construction Ltd (‘SCL’) to make payments of £400,000 to himself at a time when he knew or ought to have known this would result in the company’s insolvency. These payments were to the detriment of SCL’s creditors who are owed at least £798,952 in the liquidation and such payments were in part funded by monies obtained under the Corona Business Interruption Loan (‘CBIL’) scheme, which was a misuse of the monies under that scheme. In that: • The report to creditors states that SCL’s contracts completely ceased in March 2020 due to Government closure of construction sites; • The report to creditors also states that during April/May 2020 the Company’s turnover reduced to below £1.75m and creditor ageing extended from 40 to 60+ days. Legal notices and court summonses were being received on a daily basis. • At 01 May 2020 SCL’s bank account was in credit by £16,963; • On 11 May 2020 Mr Cooke signed an application for a CBIL to SCL’s bank for £150,000; • The purpose of the loan was stated to be general working capital requirements; • The loan was paid into the Company’s account on 13 May 2020; • Total payments into the account in May 2020 were £415,863 and payments out were £416,480, of which Mr Cooke received £400,000 as follows: o 15 May 2020 - £250,000; o 27 May 2020 - £150,000; • No satisfactory explanation has been received for these payments; • From 01 June 2020 to the CVL a further £105,758 was paid into the bank account and £70,258 was paid out. At the liquidation date the bank account was in credit by £51,845. • The statement of affairs shows total creditors of £798,952 (although the CBIL was not included) and assets with an estimated book value of £152,246. • The liquidator has received claims from creditors which date from 2018 and has identified 2 County Court Judgments, one in July 2020 and one in September 2020; • The bank statements show payments to only 2 of the 44 of the creditors on the statement of affairs from 01 May 2020.
