Conduct: On 25 September 2020 Mr Shaun Barrett ("Mr Barrett") caused Exaltra Ltd ("Exaltra") to overstate its turnover when applying for a 2nd Government backed Bounce Back Loan ("BBL") for £50,000 ("BBL2") to which it was not entitled, it being contrary to the rules of the BBL scheme: • The BBL scheme provided that only one BBL could be obtained per business and required the applicant to declare that no other BBLs had been applied for or received. • At the time of the BBL2 application Exaltra had already obtained a BBL1 on 28 May 2020 for the sum of £21,500. • The application form for BBL2 signed by Mr Barrett and dated 25 September 2020 declares that the application was Exaltra’s sole application for a BBL • When making the application for BBL2, Mr Barrett therefore falsely declared that BBL2 was Exaltra's only application for a BBL. • The amount forwarded to an applicant under the terms of the BBL scheme was based on 25% of its turnover in the calendar year 2019 ( or where a business was established after 01 January 2019, the estimated turnover from the date the business was started ). • Exaltra was incorporated on 25 January 2000 and commenced trading in July 2006. • On 25 September 2020 Mr Barrett made the application for BBL2 and declared in that application that Exaltra's annual turnover for calendar year 2019 totalled £212,000. The BBL2 funds were received by Exaltra on 09 October 2020. • In his application for BBL1, made on12 May 2020, Mr Barrett declared turnover for the 2019 calendar year of £86,973. • Exaltra's only bank account in operation during the calendar year 2019 shows total credits of £90,552 for the period 1 January 2019 to 31 December 2019. Mr Barrett therefore overstated Exaltra's turnover in the BBL2 application in order to obtain the maximum amount allowed. • As a result of the overstatement of turnover and the duplicate BBL application, Exaltra received £50,000 to which it was not entitled. • No payments were made by Exaltra Ltd in respect of BBL2 and it remained outstanding in full at the time of Liquidation.
