Conduct: Mark John Malin caused Newlyn Contractors Limited (“Newlyn”) to trade to the detriment of HM Revenue & Customs (“HMRC”) from at least 31 March 2019, with PAYE, NIC and CIS overdue from the year 2016/17 and VAT from 7 May 2021,in that – • At the date of liquidation on 23 March 2023, amounts due in respect of PAYE, NIC and CIS totaling £11,406.78 for the year 2016/17 that should have been paid in full no later than 19 May 2017 remained outstanding • further amounts in respect of PAYE, NIC and CIS, together with interest thereon, remained outstanding for the year 2017/18 totaling £2,020.69, for the year 2018/19 totaling £44,669.86, for the year 2019/20 totaling £69,266.74, for the year 2020/21 totaling £63,601.18, for the year 2021/22 totaling £86,907.35 and for the year 2022/23 totaling £102,980.21, together with penalties of £1,230.00. All of which should have been paid in full by 19 May following the respective tax year end. • VAT of £22,125.93 remained outstanding for the quarter ended March 2021, due for settlement in full by 7 May 2021. • VAT together with surcharges remained outstanding in respect of every quarter thereafter to date of liquidation, the total VAT outstanding at liquidation amounting to £515,141.91. • Newlyn’s filed Total Exemption Full Accounts show a total of £121,121 due to HMRC at 31 March 2019, increasing to £166,268 at 31 March 2020, to £239,637 at 31 March 2021 and £631,003 at 31 March 2022. • In comparison, amounts due to other creditors at the same dates totaled £655,650, £701,877, £591,568 and £370,676 respectively. • Analysis of Newlyn’s bank current account over the period 17 October 2019 to liquidation shows receipts totaling £6,187,874.45, of which £195,112.89 was paid to HMRC. • Whilst these payments included £76,910.11 on 8 August 2022, £49,883.49 on 8 November 2022 and £41,000.00 on 9 November 2022, all in respect of VAT, the overall amount owed to HMRC totaled £782,421.25 when HMRC issued a Winding Up Petition on 16 January 2023. • Creditor claims in the liquidation total £1,388,486.97. HMRC’s claim totals £936,924.72.
