Conduct: Barry David King (“Mr King”) caused Bachas Limited (“Bachas”) to apply for and obtain a Bounce Back Loan (“BBL”) of £25,000 that Bachas was not eligible for, by making false representations in the BBL application form, in that: Under the BBL scheme, businesses were entitled to borrow between £2,000 and £50,000, up to a maximum of 25% of turnover in the calendar year 2019. Therefore, to be eligible for the minimum BBL available of £2,000, Bachas would have needed turnover of at least £8,000 in the calendar year 2019. Bachas’ accounts for year ended 30 November 2019 showed turnover of £3,153 and the bank statements show receipts into the account from customers in the calendar year 2019 of £3,739, indicating that Bachas did not meet the turnover requirements of the BBL scheme. On 19 June 2019, Mr King applied for a BBL of £25,000 on behalf of Bachas. He stated in the BBL application form that Bachas’ turnover in the calendar year 2019 was £100,000. In the BBL application, Mr King declared that Bachas was carrying on its business on 01 March 2020 and that it was engaged in trading or commercial activity on the date of the BBL application. The last receipt into Bachas’ bank account from a customer was on 11 November 2019, indicating that Bachas ceased trading at around that time. As a result of the false representations made in the BBL application, Bachas obtained a BBL of £25,000 that it was not entitled to. At the date of liquidation, the BBL lender was owed £24,500.
