Modernisation of Insolvency Secondary Legislation- Links to Modernisation Rules SIs and LRO-March 2010

Following on from the new insolvency advertising regime delivered in April 2009, The Insolvency Service Policy Unit has successfully delivered the second phase of modernisation of the Insolvency Rules.

The changes implemented by the project to modernise the Insolvency Rules will provide estimated annual savings of £48 million in the cost of administering insolvencies, including the advertising changes in April 2009. These savings are expected to be passed on to creditors in the form of improved returns and the new e-delivery provisions will also provide for a significant reduction in  the insolvency carbon footprint.

The following instruments have been made and laid in Parliament, and (subject to the Parliamentary process) will come into force from 6th April 2010:

·       The Legislative Reform (Insolvency)(Miscellaneous Provisions) Order 2010 (2010 No.18);

·        The Insolvency (Amendment) Rules 2010 (2010 No.686);

·        The Insolvency (Amendment)(No 2) Rules 2010 (2010 No.734);

·        The Insolvency (Scotland) Amendment Rules 2010 (2010 No 688).
