Conduct: Lekh Ram (“Mr Ram”) caused L R S Construction Ltd (‘LRS’) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application. As a result LRS received more BBL funds than it was entitled to from the scheme, in that:?? A company could apply for a BBL of up to 25% of its turnover for either the 2019 calendar year or, if it started to trade on or after 01 January 2019, it could estimate its turnover for the calendar year from the date when it started to trade. The loan had minimum and maximum amounts of £2,000 and £50,000 respectively. LRS was incorporated on 09 May 2018. Bank statements record credits to LRS’s bank account from January 2019 to December 2019 which totalled £76,785. Based on the BBL criteria, and the company turnover from the bank statements, the company was entitled to receive no more than £19,196. On 20 May 2020, Mr Ram applied for a BBL of £50,000 and, in breach of the terms and conditions of the BBL scheme, self-certified that LRS had a turnover of £200,000 during the 2019 calendar year. LRS entered Creditors’ Voluntary Liquidation on 25 May 2022. Total liabilities at liquidation amount to £59,171 of which £50,250 relates to the amount owed in respect of the BBL.
