Conduct: On 22 May 2020, Jennifer Kate Youssef (also known as Jennifer Kate Wright) caused JKW Consultancy services Limited (“JKW”) to make a Bounce Back Loan (“BBL”) application of £50,000 when she knew or ought to have known that JKW was not eligible for the maximum amount. She made a wrongful declaration by overstating JKW’s turnover, as a result JKW has received more BBL funds than it was entitled to. In that:? Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover for the calendar year 2019. The turnover figure was self-certified by the applicant. ?? ? JKW was incorporated on 06 December 2017 and commenced trading 02 January 2018.? ? On 22 May 2020, Jennifer Kate Youssef applied for a BBL of £50,000 on behalf of JKW declaring that its turnover for the calendar year 2019 was £210,000.? ? Accounts for year ending 31 December 2019 show company turnover in that year as £44,348. Company bank statements obtained show deposits between 01 January 2019 and 31 December 2019 as £59,446. ?? JKW received the BBL funds of £50,000 on 22 May 2020.?? Between 22 June 2021 and 22 December 2021 repayments were made in respect of the BBL totalling £6,530. Total liabilities at liquidation amount to £93,543 of which £44,000 relates to the amount owed in respect of the BBL.? At liquidation the Liquidator calculated the Directors outstanding loan account to be £110,112.
