Conduct: John Charles Bryan Barnes (“Mr Barnes”) caused John Barnes Media Ltd (“JBM”) to trade to the detriment of HM Revenue and Customs (“HMRC”) during the period 1 August 2018 to cessation of trading on 31 January 2020 in respect of Corporation Tax and during the period 7 February 2019 to cessation of trading in respect of Value Added Tax (“VAT”) resulting in a liability to HMRC of £194,311. CORPORATION TAX • JBM’s corporation tax liability for its financial years ending 31 October 2017 totalled £35,783 and was due for payment on 1 August 2018; its liability for the financial year ended 31 October 2018 totalled £71,245 and was due for payment on 1 August 2019. • JBM made a payment of £28,189 on 1 August 2021, after trading had ceased, which was applied against the financial year ending 31 October 2017. • JBM incurred a corporation tax penalty in the sum of £200. VAT • JBM submitted VAT returns to HMRC for the quarters ended 12/18, 03/19, 06/19, 09/19, 12/19 and 03/20. The amount of VAT owed by JBM in respect of those returns totals £111,115 of which £107,621 was due and payable before cessation of trading on 31 January 2020. • JBM incurred surcharges for the quarters ended 12/18 and 03/19 on the sum of £7,651. • JBM did not make any payments to HMRC in respect of its VAT and surcharges from the quarter ended 12/18. APPLICATION OF FUNDS TO THE DETRIMENT OF HMRC • JBM’s turnover between 1 November 2018 to 31 October 2020 was £441,798, of which nothing was paid to HMRC. • Between 31 October 2018 and 31 October 2020 Mr Barnes increased the amount he owed to JBM by £94,832. • Mr Barnes received salary totalling £9,984 between 1 November 2018 and 31 October 2020. • At liquidation HMRC were owed £274,630 and are JBM’s only creditor.
